Digital India Bill draft soon; focus on online safety and AI

New Delhi: A full-fledged draft of the Digital India Bill, the law that will be the biggest revamp of laws governing the Internet since the Information Technology Act, 2000, and its subsequent amendments, will be released in the first week of June, Minister of State for Electronics and Information Technology Rajeev Chandrasekhar said during an industry consultation in Mumbai.

According to Chandrasekhar, the proposed approach in the draft bill is to regulate artificial intelligence (AI) through the prism of user harm.

The government plans to establish "no go areas" for certain AI technologies and create "guardrails" for high-risk AI systems. While the government aims to consolidate existing regulations into a principle-based structure, there are concerns about the potential removal of safe harbor provisions, which are seen as critical for growth and innovation in the digital economy.

Chandrasekhar clarified that the new legislation by the IT Ministry would not affect the efforts of sectoral regulators, such as the Reserve Bank of India.

The Digital India Bill is intended to harmonise various aspects of the technology space.

The minister also expressed a preference for minimal compliance burdens on startups and the innovation ecosystem, suggesting that regulators should intervene only in exceptional circumstances or when independent intervention is required, similar to the proposed Data Protection Board.
